1. Introduction and Acceptance of Terms

Welcome to Scored ("App", "Service", "we", "us", or "our"), a photo analysis application developed and operated globally. These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Scored governing your access to and use of the App and all related services.

By registering, downloading, accessing, or using the Scored App, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree with any part of these Terms, you must immediately cease use of the App and delete your account.

These Terms apply to all users globally. Where local laws impose additional obligations, those obligations shall apply in addition to these Terms.

2. Eligibility

To use the Scored App, you must:

  • Be at least 18 years of age, or the age of majority in your jurisdiction if higher;
  • Have the legal capacity to enter into a binding agreement;
  • Not be prohibited from using the App under any applicable laws;
  • Provide accurate, complete, and current information during registration.

By using the App, you represent and warrant that you meet all eligibility requirements. Scored reserves the right to suspend or terminate accounts found to be in breach of these eligibility criteria without prior notice.

3. Account Registration and Security

To access the core features of Scored, you must create an account using a valid email address. Registration is completed via a One-Time Password (OTP) sent to your registered email. You are responsible for:

  • Maintaining the confidentiality of your account credentials;
  • All activities that occur under your account;
  • Promptly notifying Scored of any unauthorized access or security breach via our support channels;
  • Ensuring your registered email address remains accurate and accessible.

Scored is not liable for any loss or damage arising from your failure to comply with these security obligations. You may not transfer your account to any third party without express written consent from Scored.

4. Description of Services

Scored is a photo analysis platform that uses artificial intelligence and algorithmic models to evaluate user-submitted photographs. The App provides:

  • An Overall Score and Potential Score for each uploaded photo;
  • Parameter-specific scoring including, but not limited to, attributes such as attractiveness, trustworthiness, and other contextual metrics;
  • Contextual analysis based on the intended use of the photo: Business, Dating, or Social purposes;
  • Identification of strengths in the submitted photo;
  • Actionable recommendations to improve photo performance scores.

All scores, ratings, and recommendations are generated by automated systems and are intended solely for informational and self-improvement purposes. They do not constitute professional advice of any kind and should not be treated as definitive assessments of any individual.

4A. AI Processing and Third-Party AI Services

4A.1 Use of Artificial Intelligence

The Scored App uses artificial intelligence and machine learning systems to analyse photographs submitted by users. All photo scoring, attribute analysis, and improvement recommendations are generated by automated AI models. These outputs are probabilistic in nature and are intended solely for informational and self-improvement purposes.

4A.2 Third-Party AI Providers

To deliver photo analysis, Scored may transmit your uploaded photographs to one or more third-party AI service providers. These providers process your photo solely for the purpose of generating your score and analysis results. Third-party AI providers currently used by Scored may include services such as cloud-based machine learning platforms and computer vision APIs. Scored will update this section when the specific providers used change materially.

4A.3 Data Shared with Third-Party AI

When you upload a photograph for analysis, the following data may be transmitted to third-party AI services:

  • The photograph you submit;
  • Technical metadata associated with the image (such as file format and resolution);
  • The analysis context you select (Dating, Business, or Social).

Scored does not transmit your name, email address, or account credentials to third-party AI providers in connection with photo analysis.

4A.4 Your Consent

By uploading a photograph for analysis, you explicitly consent to your photograph being processed by Scored's AI systems and any third-party AI providers used to deliver the analysis. You will also be asked to confirm this consent within the App before your first photo is processed. If you do not consent to AI processing of your photograph, you should not upload photos for analysis.

4A.5 AI-Generated Output Disclaimer

All scores, ratings, potential scores, and recommendations produced by the App are AI-generated outputs. They do not constitute factual assessments of any individual's appearance, attractiveness, character, or suitability for any purpose. Scored makes no warranty as to the accuracy or reliability of any AI-generated output.

5. Subscription Plans and Payments

Access to photo scores and analysis results requires an active subscription plan. The following terms apply to all subscriptions:

5.1 Subscription Activation

Users must select and activate a paid subscription plan before viewing any photo score or analysis result. Uploaded photos will be queued and results will be accessible upon successful subscription activation.

5.2 Billing and Renewal

Subscription fees are billed in advance on a recurring basis (weekly, monthly or annually, depending on the plan selected). Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You authorize Scored to charge your payment method on file for each renewal period.

How to Cancel Your Subscription: If you subscribed via the Apple App Store, you must cancel through your Apple ID subscription settings. To do so, open the Settings app on your iOS device, tap your name, tap Subscriptions, select Scored, and tap Cancel Subscription. You may also manage your subscription at https://apps.apple.com/account/subscriptions. Cancellation takes effect at the end of the current billing period; you will retain access to paid features until that date. Deleting the App does not automatically cancel your subscription — you must cancel through your Apple ID settings to stop future charges.

5.3 Refund Policy

All subscription fees are non-refundable except where required by applicable law. Scored reserves the right to modify pricing with reasonable prior notice. Continued use of the App after a price change constitutes acceptance of the new pricing.

5.4 Free Trials

Where a free trial is offered, it will be specified at the time of sign-up. Upon expiry of the trial, your subscription will automatically convert to a paid plan unless cancelled before the trial period ends.

5A. Fair Use Policy

5A.1 Purpose

Scored's Annual Plan is offered on an "unlimited photo analysis" basis, meaning subscribers may submit an unlimited number of photos for scoring and analysis during their subscription period. This unlimited entitlement is intended for genuine personal use — specifically, to allow individuals to iteratively improve their photos across dating, business, and social contexts without restriction.

This Fair Use Policy exists to protect the integrity, performance, and availability of the Scored Service for all users. It is not intended to limit ordinary personal use in any way. The overwhelming majority of users will never approach the thresholds described in this section.

5A.2 What Constitutes Fair Use

Fair use of the Scored Service includes, without limitation:

  • Uploading and scoring your own personal photographs for the purpose of self-improvement;
  • Re-uploading edited or updated versions of photos to track score improvement over time;
  • Scoring photos across multiple contexts (Dating, Business, Social) for the same photograph;
  • Uploading photos from a single album, portfolio, or dating profile for comparative analysis;
  • Using the Transform feature (where available) on photos you have uploaded and scored.

5A.3 What Constitutes Excessive or Abusive Use

The following activities fall outside the scope of fair personal use and are not permitted under any subscription plan, including the Annual Plan:

  • Automated or bulk submissions: Using scripts, bots, APIs, macros, or any automated process to submit photos in bulk or at a rate that exceeds normal human usage patterns;
  • Commercial resale: Submitting photos on behalf of third parties for commercial gain, operating a resale service built on Scored's analysis, or using Scored's output as a commercial product or API without a separate commercial agreement with Scored;
  • Third-party processing at scale: Uploading photos belonging to, or depicting, large numbers of different individuals for the purpose of bulk scoring or data harvesting;
  • Stress testing or systematic probing: Deliberately submitting high volumes of photos to test system capacity, probe infrastructure, or map scoring behaviour;
  • Data extraction: Systematically extracting, aggregating, or storing Scored's analysis output for the purpose of training competing AI models, building derivative datasets, or commercial intelligence gathering;
  • Account sharing: Sharing a single account or subscription across multiple individuals, households, or organisations as a means of circumventing per-user pricing.

5A.4 Indicative Usage Standards

Scored's Annual Plan is designed for genuine personal use by an individual user. While the plan provides generous access to photo analysis, usage that appears inconsistent with normal personal behaviour — including unusually high submission volumes, repetitive bulk uploads, or patterns suggesting automated or commercial use — may be reviewed by Scored and may be considered outside the scope of fair personal use.

Scored does not publish specific numeric thresholds for photo submissions. Usage is assessed holistically based on patterns, frequency, and context rather than against fixed limits. Occasional intensive use — for example, during a period of active profile optimisation — will not ordinarily be considered inconsistent with personal fair use.

To maintain a high quality of service for all users, Scored applies technical usage controls within the App. These controls are set generously above normal personal usage levels and are designed to be invisible to genuine personal users. Users who reach a usage threshold will be notified within the App and advised when their access will next be available.

5A.5 Scored's Rights on Detection of Excessive Use

Where Scored determines, in its reasonable discretion, that a user's activity falls outside fair personal use, Scored reserves the right to take one or more of the following steps:

  • Contact the user directly to discuss usage patterns before taking any further action;
  • Apply temporary rate limiting to the account to restore normal service levels for other users;
  • Request that the user upgrade to a commercial or enterprise plan appropriate to their usage;
  • Suspend or terminate the account in cases of deliberate abuse, automated access, or commercial resale without prior agreement.

Scored will endeavour to notify the user and provide a reasonable opportunity to respond before taking any action under this section, except in cases of clear and deliberate abuse where immediate action is necessary to protect the Service.

5A.6 Commercial and Enterprise Use

If you intend to use Scored for commercial purposes — including but not limited to photography businesses, talent agencies, professional coaching services, or building products that incorporate Scored's analysis — you must contact Scored in advance to discuss a commercial or enterprise licensing arrangement. Use of the Service for commercial purposes under a personal subscription plan is not permitted.

5A.7 Relationship to Acceptable Use Policy

This Fair Use Policy supplements and should be read alongside Section 6 (Acceptable Use Policy). In the event of any conflict between this section and Section 6, the more restrictive provision shall apply.

6. Acceptable Use Policy

You agree to use the Scored App only for lawful purposes and in accordance with these Terms. You must not:

  • Upload photos depicting nudity, sexual content, violence, or any illegal or harmful material;
  • Upload photos of individuals under the age of 18;
  • Use the App to harass, bully, defame, or harm any individual;
  • Attempt to reverse-engineer, decompile, or tamper with the App or its underlying systems;
  • Use automated scripts, bots, or scrapers to access or extract data from the App;
  • Upload photos without the consent of any identifiable individuals depicted therein;
  • Use the App in any manner that could disable, overburden, or impair its functionality;
  • Misrepresent your identity or affiliation with any person or entity;
  • Violate any applicable local, national, or international laws or regulations.

Scored reserves the right to remove any content and suspend or terminate any account that violates this Acceptable Use Policy without notice or liability.

7. Intellectual Property

All intellectual property rights in the App, including but not limited to software, design, trademarks, logos, algorithms, scoring methodology, text, and graphics, are owned by or licensed to Scored. Nothing in these Terms grants you any ownership rights in the App or its content.

By uploading a photo to the App, you grant Scored a non-exclusive, worldwide, royalty-free, sublicensable license to use, process, analyse, and store your photo solely for the purpose of delivering the requested analysis and improving our Services. This license terminates when you delete the photo or your account, subject to data retention obligations.

You retain all ownership rights in the photos you upload. You represent and warrant that you own or have the necessary rights to upload any photo submitted to the App.

8. Disclaimers and Limitation of Liability

8.1 Nature of Analysis

Scored's photo analysis is generated by artificial intelligence and algorithmic models. All scores, ratings, and recommendations are subjective, probabilistic outputs and must not be construed as factual assessments of a person's appearance, character, or professional suitability. Scored makes no warranties as to the accuracy, completeness, or fitness for purpose of any analysis result.

9. Indemnification

You agree to indemnify, defend, and hold harmless Scored, its officers, directors, employees, agents, and partners from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you upload to the App.

10. Termination

Scored may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. Termination does not entitle you to any refund of subscription fees paid.

10.1 Account Deletion by User

You have the right to delete your account at any time directly within the App. The account deletion option is accessible via: Settings. Initiating account deletion will permanently erase your account record and all associated personal data, including uploaded photos, analysis history, and profile information, subject to our legal data retention obligations as described in the Privacy Policy.

Important — Subscription Before Deletion: If you have an active subscription purchased through the Apple App Store, deleting your account will not automatically cancel your subscription. You must cancel your subscription separately through your Apple ID settings before or after deleting your account to stop future billing. Scored is not responsible for charges incurred as a result of failing to cancel an active subscription prior to account deletion.

Account deletion requests are processed within 30 days. Some data may be retained beyond this period where required by applicable law (e.g. financial records). See Section 6 of our Privacy Policy for full retention details.

Sections 7, 8, 9, 11, and 12 shall survive termination of these Terms.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable law. In the event of any dispute arising from or in connection with these Terms or the App, the parties agree to first attempt resolution through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in accordance with internationally recognised arbitration rules. Nothing in this clause prevents either party from seeking urgent injunctive relief from a court of competent jurisdiction.

12. Modifications to Terms

Scored reserves the right to modify these Terms at any time. We will notify registered users of material changes via email or in-App notification. Your continued use of the App after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must discontinue use of the App.

13. Third-Party Services and Links

The Scored App may integrate with or contain links to third-party services, websites, platforms, or content that are not owned or controlled by Scored. This includes, but is not limited to, third-party payment processors, analytics providers, cloud infrastructure services, and email delivery platforms. These integrations are used solely to support the operation and delivery of the Scored Service.

Scored has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party services. We do not endorse any third-party services referenced within or linked from the App. You acknowledge and agree that Scored shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with your use of or reliance on any third-party content, goods, or services.
